Section 889 Compliance

This clause states that the government may not purchase or buy products that use prohibited technology as a significant or essential component of any system, or as crucial technology as part of any system. This rule helps to ensure the security and dependability of the government’s technology systems.   The word “prohibited technology” refers to the specific forms of technology listed in Section 889. This comprises telecommunications equipment and services produced by Huawei and ZTE Corporation, as well as any of its subsidiaries or affiliates. Furthermore, video surveillance and telecommunication equipment and services manufactured by Hytera

Communications Corporation, Hangzhou Hikvision Digital Technology Company, and Dahua Technology Company, or any of its subsidiaries or affiliates, are also considered prohibited technology. The Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the FBI, has the authority to add to this list.

It’s important for contractors to be aware that Section 889 does not provide an exemption for commercial item contracting. This means that the prohibition applies to all purchases, regardless of the size of the contract or order. This includes purchases below the Micro-purchase and Simplified Acquisition Thresholds.
